These Terms and Conditions of Use (the "Terms") govern access to and use of the websites, mobile applications, tools, services, features, content, interfaces, communications, and related offerings operated by Grupo BAU S.A. (collectively, the "Platform").
By accessing, browsing, creating an account, posting a listing, submitting an inquiry, purchasing a service, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Grupo BAU S.A. is the operator of the Platform. The Platform is a technology service that enables users to publish, search, compare, promote, and inquire about real estate opportunities and related services on a worldwide basis.
Grupo BAU provides a digital marketplace and communications platform. Grupo BAU is not a real estate broker, real estate agent, property manager, escrow company, title company, mortgage lender, appraiser, inspector, legal advisor, tax advisor, financial advisor, insurer, landlord, seller, buyer, or developer, unless expressly stated in writing for a specific service.
We do not represent any party in a real estate transaction merely by operating the Platform.
The Platform may display listings, advertisements, property descriptions, estimated values, images, maps, market information, availability data, price data, user reviews, or other materials submitted by users, partners, advertisers, or third parties. Unless expressly stated otherwise, such content is provided for general informational purposes only.
You may use the Platform only if:
If you use the Platform on behalf of an entity, you represent and warrant that you are authorized to bind that entity to these Terms.
Certain features require an account. You agree to provide accurate/current/complete information, keep credentials confidential, update account data promptly, accept responsibility for account activity, and notify us of unauthorized access or misuse.
We may suspend, restrict, or terminate accounts that are inaccurate, inactive, unlawful, misleading, insecure, or in breach of these Terms.
The person or entity posting a listing is solely responsible for that listing and related content, and represents that they have authority and legal rights to publish and that content is lawful, accurate, non-misleading, authorized, and legally compliant.
Grupo BAU does not independently verify all listing content, ownership claims, pricing, availability, legality, licensing, permits, square footage, property condition, zoning, title status, or transaction readiness. We do not guarantee listing accuracy, completeness, currency, legality, or availability. You must independently verify before relying or transacting.
We reserve the right (without obligation) to review, edit, reject, suspend, unpublish, demote, restrict, label, or remove listings/content when we believe they violate Terms, are misleading or risky, involve fraud/unlawful conduct, include prohibited material, or infringe third-party rights.
"User Content" means any information, text, media, documents, feedback, data, or material submitted through the Platform. You retain ownership, but grant Grupo BAU a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, display, distribute, promote, publish, communicate, and otherwise use such content for operation, improvement, protection, and promotion of the Platform and services. You represent that you have rights necessary to grant this license.
You agree not to (and not allow others to): post false/fraudulent/deceptive content; impersonate others; submit unlawful/infringing/abusive/discriminatory material; violate housing/advertising/privacy/sanctions/export/consumer laws; scrape/crawl/data-mine/extract without authorization; use unauthorized bots/automation; interfere with platform operation/security; bypass access controls; upload malicious code; misuse personal data; send spam; republish/resell content without authorization; or use platform content to build/train competing datasets, services, or models without express written permission.
The Platform may enable user-to-user contact. Grupo BAU does not guarantee responses, outcomes, identities, service quality, or legitimacy of counterparties. Transactions arising from Platform use are solely between the relevant parties unless Grupo BAU expressly acts as direct contracting party in a specific product. You are responsible for due diligence and professional judgment.
The Platform may offer paid products (featured placements, plans, advertising, data tools, lead products, etc.). Pricing, billing cycles, and core commercial terms are disclosed at/before purchase; taxes may apply; third-party processors may handle payments; recurring services may auto-renew where disclosed and lawful; and you authorize charges under selected services.
Unless required by law or expressly stated, fees are non-refundable once activated, delivered, reserved, or materially consumed. Grupo BAU may suspend/terminate paid services for non-payment, chargebacks, fraud risk, abuse, or breach.
The Platform (software, layout, branding, logos, design, databases, text, graphics, interfaces, functionality, and non-user content) is owned by or licensed to Grupo BAU and protected by applicable laws. Except as expressly permitted, no part may be copied, reproduced, distributed, published, displayed, licensed, sold, transmitted, reverse engineered, decompiled, or exploited without prior written authorization.
The Platform may include third-party listings, maps, media, integrations, links, calculators, payment services, verification tools, and external resources. Grupo BAU does not control and is not responsible for third-party content/services/policies/security/accuracy. Access is at your own risk and may be subject to separate terms.
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you acknowledge processing as described there.
To the maximum extent permitted by law: the Platform is provided "as is" and "as available"; Grupo BAU does not warrant uninterrupted, secure, error-free operation; does not warrant accuracy, completeness, legality, availability, reliability, suitability, merchantability, fitness, title, or non-infringement; does not guarantee listing outcomes; and does not guarantee conduct/identity/licensing/solvency/authority/performance of users or third parties. Some jurisdictions may limit these disclaimers.
To the maximum extent permitted by law, Grupo BAU and related parties are not liable for indirect, incidental, consequential, special, exemplary, punitive, or speculative damages (including profit/revenue/data/opportunity/reputation loss or business interruption) arising from or related to platform use, reliance on content, user communications/transactions, third-party misconduct, interruptions/security incidents, moderation/account actions, or content errors/delays.
Aggregate liability is limited to the greater of: (a) amount paid by you for the specific paid service giving rise to the claim in the 12 months before the event; or (b) USD $100. Nothing limits liability that cannot be lawfully limited.
You agree to defend, indemnify, and hold harmless Grupo BAU and related parties from claims, losses, liabilities, penalties, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Platform, User Content, listings, Terms violations, law violations, third-party rights infringement, or disputes/transactions with others.
We may suspend, restrict, or terminate access, remove content, or close accounts at our discretion and without liability when necessary for security, legal compliance, integrity, business reasons, fraud prevention, or Terms enforcement. You may stop using the Platform at any time and follow account closure processes where provided. Provisions that should survive termination will survive.
These Terms are intended for worldwide use and apply to the maximum extent permitted by law. Any dispute should first go through good-faith informal resolution via official Platform contact channels, with reasonable efforts to resolve within thirty (30) days.
If unresolved, disputes are submitted to competent courts where Grupo BAU S.A. is legally established, unless mandatory consumer law requires another forum/law. Nothing here waives non-waivable consumer rights.
We may modify these Terms from time to time. Updated Terms are effective upon publication unless another date is stated. For material changes, we may provide additional notice. Continued use after the effective date means acceptance to the extent permitted by law.
If any provision is invalid/illegal/unenforceable, the remainder remains in effect. Failure to enforce any provision is not a waiver. You may not assign/transfer rights/obligations without consent. We may assign/transfer these Terms in corporate transactions or by law. These Terms, the Privacy Policy, and specific service terms constitute the entire agreement regarding the Platform.
Questions, complaints, legal notices, and account-related communications should be submitted through the official contact channels published on the Platform.
